In January of 2007, Sugarcreek Township began work on updating our Comprehensive Development Plan and Zoning Resolution, with an eye on creating synergy between the documents, bringing them up to date with current conditions and making them easier to use and understand. An ad hoc advisory group was charged with reviewing the documents and making recommendations to the Board of Township Trustees.

PROPOSED AMENDMENTS TO THE ZONING RESOLUTION
Shortly after the updated Comprehensive Development Plan was adopted in November of 2007, the ad hoc advisory group began reviewing the Zoning Resolution, section by section, and proposing updates and revisions where necessary. A preliminary draft of the updated Zoning Resolution was submitted to the Greene County Regional Planning and Coordinating Commission (RPCC) and the Greene County Prosecutor's Office for review. Comments were received from the RPCC and the Prosecutor's Office on the preliminary draft and a final draft was prepared incorporating suggestions and comments as appropriate. The ad hoc advisory group has completed review of the final draft Zoning Resolution. The final draft Zoning Resolution underwent an additional review by the RPCC and additional review by legal counsel. The process for review of the final draft Zoning Resolution is as follows:

INITIATION AND RPCC REVIEW AND RECOMMENDATION:
On June 1, 2009 the Board of Township Trustees initiated text amendments to the Zoning Resolution as recommended by the ad hoc advisory group and the final draft Zoning Resolution was submitted to the Greene County RPCC for its review and recommendation to the Sugarcreek Township Board of Zoning Commission (BZC). Public Hearings with the RPCC on the final draft Zoning Resolution were held on July 21, 2009 (RPCC Executive Committee) and July 28, 2009 (RPCC Full Commission).  The RPCC provided a recommendation to the Sugarcreek Township BZC on the final draft Zoning Resolution. Review by the Prosecutor's Office is ongoing.

PUBLIC HEARINGS WITH THE BZC AND BZC RECOMMENDATION:
On July 14, 2009 the Sugarcreek Township BZC held a Public Hearing on the final draft Zoning Resolution. A second Public Hearing on the final draft Zoning Resolution with the Sugarcreek Township BZC was held on December 8, 2009.  At the December 8, 2009 BZC Meeting, the BZC voted unanimously to rececommend approval of the Public Review Draft of the Sugarcreek Township Zoning Resolution (Revised November 20, 2009) subject to changes regarding the ability of the BZC and Board of Township to request traffic impact studies and studies relative to findings to substantiate that proposed developments will not have an adverse impact on public services, subject to changes relative fees for development proposals, subject to changes regarding the description of the density bonus in the R-PUD District, subject to changes that will allow temporary tents for special events in all zoning districts, subject to text relative to standards for stormwater management facilities, and subject to a clarification that two types of landscaping materials are required at the base of permanent ground signs. 

PUBLIC HEARING(S) WITH THE TOWNSHIP TRUSTEES AND ADOPTION CONSIDERATION:
At a Public Hearing tentatively scheduled for May 3, 2010 at 7:30 p.m. at the Sugarcreek Township Administration Office, 2090 Ferry Road, Bellbrook, Ohio the Sugarcreek Township Trustees will consider the comments and recommendations received from the RPCC and the BZC on the final draft Zoning Resolution. Additional Public Hearings with the Township Trustees may be scheduled if necessary. At the conclusion of the Public Hearing process with the Township Trustees, the Board of Township Trustees will vote on the the adoption of the final draft Zoning Resolution. The new text becomes effective thirty (30) days from the date of approval by the Township Trustees.
